This website is owned and operated by the Vickery Residential Association. These Terms establish terms and conditions under which you may use our website and services offered by us. By accessing or using the VickeryLife website, you approve that you have read, understood, and agree to be bound by these Terms.

We respect your privacy and want you to understand how we collect, use, and share your personal information when you use our Site. In addition to these Terms of Use, we encourage you to review our Privacy Policy.

Who Can Use Our Site
The VickeryLife website (hereafter, “the Site” or “our Site”) contains a public homepage as well as areas and pages that are exclusively for the use of our site members. The public areas of the site are intended to be informational in nature and may be browsed by anyone. To see or use the member areas of our site, you must be at least 13 years old and be verified as either a current homeowner or resident in Vickery. When you register for site membership, you are certifying that either:

You are listed on publicly available tax records or property management records as an owner of record for that address, OR

You are a current resident of the associated Vickery address.
When you register as a property owner, you are agreeing to have your membership eligibility verified through property management records or through publicly available property tax records. If you are a tenant, additional family member, roommate or other resident, you agree to have your name and email address checked against those provided by the registered property owner to determine your membership eligibility.

Protecting Your Account
You are responsible to safeguard your Login credentials for the VickeryLife site and to ensure they are used only by you. Sharing your credentials with others for the purposes of providing access to member information or services is not permitted under the Terms of the VickeryLife site. You are responsible for all website activity that is associated with the use of your Login credentials and you agree to notify the website administrator immediately if you have reason to believe that your credentials have been used by someone other than you.

Collection of Fees/Sale of Services
Vickery Residential Association may use the VickeryLife site to collect fees for certain services or to offer certain services for sale. For example, we may sell tickets for community events and activities or collect rental fees for amenity rentals. Unless otherwise specified, sales of goods or services are restricted to site members only.
By using the VickeryLife site to purchase a good or service or to pay a fee, you are agreeing that you are voluntarily entering into a legally binding agreement and that you have the legal right to enter into a contractual relationship with Vickery Residential Association. It is your responsibility to read and understand all the details related to your purchase prior to submitting your payment.

The prices for the services we provide are always listed clearly on our Site and vary based on the type of service. The Vickery Residential Association reserves the right to set the prices and fees associated with any goods or services it provides and to change them at its discretion, with or without notice.

Prohibited Uses
Our site is being made available in good faith and for informational purposes and convenience. You agree NOT to use our site in any of the following ways:

In the case of our online Resident Directory, your use of published information is strictly for personal communications only, and such communications may not violate any applicable laws.

Account Termination

Your eligibility to have an account on the VickeryLife site and to access certain membership areas of the Site is tied to certain eligibility requirements as detailed elsewhere in these Terms of Service. You agree that your account will be terminated once you no longer meet these eligibility requirements. In the event that there is a delay in terminating your account, you agree not to access member-specific areas of the Site or engage in activities or services specifically targeted to or intended for Members once you no longer meet the eligibility requirements.

You may discontinue use and request to cancel your account and/or any services at any time.

Advertising
Our Site may contain information, logos, and offers of goods or services supplied to us by advertisers or sponsors who may or may not pay a fee to the Vickery Residential Association. The presence of such information does not imply endorsement by us of the goods or services being offered or of the businesses or individuals making such offers. The administration, redemption, and terms of any services or offers made through our Site are strictly the responsibility of the advertiser. We do not monitor or control the terms, pricing, redemption, or eligibility for any advertised services or offers. As always, your engagement or activity with any business is at your own risk.

Content appearing on the VickeryLife site may be created by or on behalf of the Vickery Residential Association or may be obtained from or provided by other third-party sources, including realtors, advertisers, community partners, vendors, service providers, or others. While we exercise care in the preparation and editing of our original content and in the review of third-party content that appears on our site, we do not warrant or guarantee its accuracy, completeness, timeliness or reliability. As a user of our site, you acknowledge and accept that typographical errors, errors of fact, omissions, and outdated information may exist and accept sole risk and responsibility for your reliance on or use of information obtained through our site. By visiting this site you agree that the Terms of Use shall be governed by and construed in accordance with the laws of the State of Georgia and the USA, without giving effect to any principles of conflicts of law, and that any action at law or in equity arising out of or relating to these Terms of Use and the Privacy Policy shall be filed only in the state or federal courts located in Forsyth County, Georgia and you hereby consent and submit to the venue and personal jurisdiction of such courts for the purposes of such action. If any provision of these Terms of Use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement between us relating to the subject matter herein and shall not be modified except in writing, signed by both parties.

This Privacy Policy outlines how the Vickery Residential Association handles your personal information. We recommend that you review this Policy in detail. If you do not understand this Policy, or you disagree with the practices outlined in it, you should discontinue use of our Site immediately.

We collect two types of information from you: information that is specifically tied to your identity and that you provide to us; and information that is collected automatically by our Site in order to provide us general, aggregated data about how people use our Site.

User-Provided Information
In order to access certain areas of our Site and to take advantage of certain services we offer, we require you to register. When you register for our site, you voluntarily provide us personally identifying information (Name, Email, Address) that we use to verify your eligibility for site membership and to manage your account. Certain other services we provide may require you to furnish additional information. For example, if you are purchasing tickets for a community event, you may be asked for additional registration information as well as for a credit card number and expiration date in order to process your payment. We may now or in the future offer certain types of online form submissions for your convenience. These forms may ask for information relevant to the type of form you are submitting. For example, an online architectural review application may require a description of the modification you are requesting, as well as related photos and plans.
Automated Data Collection & Cookies
Like most websites, our Site collects aggregated data via automated technologies that are integrated into our web hosting platform and in related applications used on our Site. .

Most of this data is gathered through the use of cookie technology. Cookies are small bits of data that are embedded into your web browser when you visit websites. Like most websites, our Site uses cookies to streamline the navigational experience, to provide services related to authentication and security, and to analyze the performance of our Site. Communications Opt-Out
The Vickery Residential Association has chosen to use the VickeryLife website as its main communications mechanism with homeowners and residents. Types of communications you may receive through the Site include: emails notifying you of Board decisions and actions, meetings, changes in community personnel/vendors or policies, community events, and other items of general interest to Vickery homeowners and residents. Many of these communications are also passively archived on our Site for your review.

You may opt-out of these communications at any time by notifying us at webadmin@vickerylife.com and we will remove you from the distribution list. In the event that you opt-out of communications from us, please note that you will not receive any news or notifications from the Vickery Residential Association or its management, except for specific types of notifications that are individual to you and that are processed through a separate property management website. You will also continue to receive mailed notification of the Annual Meeting and annual budget for as long as such type of notification is required under Georgia law.
Resident Directory
The VickeryLife site may contain a link providing you with a way to update your information in upcoming issues of the Vickery Resident Directory. This link currently takes you to a form that is external to our Site. Your participation in the Resident Directory is solely voluntary, as is the amount and type of information you choose to provide. Although your responses are NOT stored digitally on our Site, we may display a digital version of the completed directory in the member area only once the print version has been delivered. While the use of this information is governed by our Site Terms of Service and we do not share it externally, we do not guarantee compliance of other Site members.

Ads and Third-Party Links
Advertising on our Site is strictly controlled by us and is limited to those with whom we have an established advertiser relationship. Our Site does not permit access to third-party advertisers that may deploy cookies on your browser through our Site. However, there are links on our site (some of which may be connected with advertisers) which lead to other sites not owned or controlled by us. We do not know nor can we be liable for the ways in which third-party sites may collect and use your personal information. We encourage you to read the Privacy Policy for these sites prior to using them, as their policies may differ from ours.

Who Can See Your Information?
The user-provided information we collect is for the use of the Vickery Residential Association, its agents, and employees. We limit the visibility and use of your personal information to those whose need serves a legitimate purpose related to the Vickery Residential Association, including the designated property manager, website administrators, members of the Board of Directors, and–in limited cases– official committee members. The information released is limited to only what is required to fulfill a specific and relevant purpose.

There are certain third parties that have access to your information as a result of the services they provide to us. These trusted third parties include employees of our web hosting service that perform related IT and web development functions and third-party payment providers that process transactions on our behalf.

Sharing of Your Personal Data
The Vickery Residential Association does not sell, rent or trade your personal data at any time or for any reason. Except as noted above, we also do not share your personal data, except under very particular circumstances, as follows: 1) To comply with a legal requirement, such as a subpoena or court order; 2) To cooperate with a law enforcement inquiry; or 3) If we believe in good faith that you have violated our Terms of Service in a way that is unlawful or that exposes us or third parties to harm or legal liability.

We may from time to time share our aggregated non-personal data with others, including current and potential future advertisers.

Security Statement
The security of your personal information is important to you and to us. Our third-party web hosting service and payment service partners utilize SSL technology and https protocols to ensure that transmitted information is encrypted and is at minimal risk of interception by third parties. Sensitive personal information such as passwords and credit card numbers are never visible to website administrators or others with administrative permissions.

Refunds and Cancellations
Policy
Before you submit any kind of payment on our Site, we want you to clearly understand our Refunds and Cancellation Policy.
The Vickery Residential Association has adopted the following Policy related to Cancellations and Refunds of payments received for the services we offer on the VickeryLife site. If you do not understand this Policy, or you do not agree with its provisions, you should not make purchases on our Site.

Ticketed Events:
Unless otherwise indicated, Vickery Events are for the enjoyment of current Vickery residents and their accompanied guests. Ticket purchases are restricted to eligible Site members.
​
If we cancel:
We try our best not to cancel community events. However, there are certain situations in which event cancellation may be necessary. In the unlikely event that we cancel an event and you have purchased a ticket, you will receive a full refund for the purchase price of the ticket in the original form of payment.
If an offline payment method was offered for a particular event (for example, a check option) and your payment was already processed, your refund will be sent in the form of a check.
Please allow at least 3 to 5 business days to process credit card refunds and up to 30 days to process check refunds paid by check.
If you can’t attend:
Due to the costs to us of planning and executing events–including vendor deposits and prepaid costs of supplies–we regret that we cannot accommodate individual requests for ticket refunds. If you have purchased an event ticket and experience a hardship that prevents you from attending, you may contact the property manager. Hardship requests will be evaluated on a case-by-case basis by the manager, the Events Committee, and the Board of Directors and decisions to issue refunds for ticket purchases will be at their sole discretion.
Amenity Rental Fees:
Currently, the rental of Vickery amenities is limited to residents only. To reserve online, you must be an eligible Site member.

If we cancel:
It is extremely unlikely that we would need to cancel a finalized reservation for an amenity rental. If the cancellation is the result of an error on our part, an act of God, or an unanticipated issue on our end, we will notify you as soon as possible and refund your entire rental fee in the original form of payment.
If you cancel:
Due to the increasing demand for our amenity spaces for private events, we ask that you confirm your plans prior to reserving a date. If you must cancel, please do so as far in advance as possible so that others have a chance to reserve. Cancellation requests received by the property manager by 9AM on the Friday PRIOR to your scheduled event will be refunded in full LESS any transaction fees charged by our website providers and third-party payment providers. Alternatively, you have the option to reschedule your reservation on another available date. If you choose to reschedule your reservation, no refund will be issued.
If you request a cancellation, you forfeit the right to use the amenity for your event.
